TERMS OF USE
Below are the general terms of use and protection policy applicable to the site:
1. General
The sole proprietorship ATHANASIADIS KONSTANTINOS, located at 10 Ethnikis Antistasis Street, Ptolemaida, P.C. 50200, P.O.Y. 149202607, Ptolemaida Tax Office and G.E.M.I. 134051636000 offers the possibility of online shopping (hereinafter referred to as "shopping") through the website www.thecart. gr, which is an online shop selling products, under the following terms of use, which visitors/users are invited to read carefully and to visit/use its pages/services only if they fully accept them.
2. Acceptance of the Terms
2.1 Any use of the Website implies the full and unconditional acceptance of these Terms of Use (hereinafter the "Terms") by its users (hereinafter the "Users" or "You"). These Terms apply to any use of the Site and to any purchase you make through the Site's online store or other means of communication. The Terms are in full force and effect as if signed in writing. If you do not agree to these Terms, please do not use the Site. By using the Site in any way, you represent that you have the right and ability to enter into this Agreement and that you will comply with all of these Terms.
3. Intellectual Property Rights
3.1 Apart from the exceptions mentioned (copyright, trademarks and distinctive signs of third parties, partners and institutions), all the content of the site, including but not limited to images, graphics, photographs, drawings, texts, the services provided and generally all the files of this website, constitute intellectual property, intellectual property rights, intangible assets of the company and are protected by the relevant provisions of Greek law, European law, European law and the law of the European Union. Their appearance and display on the Website should in no way be construed as a license to use these trademarks by anyone without the written permission of the Company.
3.2 Users understand and accept that they are not granted the right to reproduce, copy, sell, resell and/or commercially exploit in any way, all or part of the content of the Site.
Furthermore, it is prohibited to decompile or in any way unauthorized use of the software of the Site.
3.3 Any infringement of the Intellectual Property rights referred to in paragraphs 3.1 and 3.2 of this article in any way shall incur the responsibilities and penalties established by law.
4. Processing of personal data
The processing of Users' personal data is carried out in accordance with the Privacy Policy (hyperlink) of the Website.
5. Contract Information - Prices
5.1 The Merchant shall provide clear, accurate and understandable information about the Product before completing a purchase (e.g. main features, total price including taxes, delivery costs and any other additional charges (if applicable)).
5.2 The indicated final prices of the products include VAT; the Merchant reserves the right to adjust the prices of the products at its discretion. If there are changes in the price of a product, the new price is not retroactive to previous orders before the price change. The price available at the time of the order shall apply.
5.3. Users are accurately informed about the availability of the products of the e-shop. In case of unavailability for any reason, part of the products of the order, the company will contact the user by phone or e-mail and execute the order upon request. In the event that, for any reason, neither of the above two communications is possible for a period of 10 days from the sending of the order request, the order request is executed normally for the remaining available products and the amount of the value of the unavailable product, if it was paid, is refunded with the corresponding payment method selected by the user, according to the following. Any payments will be returned to the User without undue delay, in the same way that the User chose to pay for his/her order.
5.4 The various product offers that appear in the online store (with the indications "Offer", "Web opportunity", "Discount" or similar expressions) are always valid until stocks are exhausted. For these items, a strict order of priority in the execution of orders is strictly observed.
5.5. The availability of products available through the site may differ from the availability of products available through physical stores. Therefore, there are products which may be available for purchase from physical stores and not from the Site, and vice versa. This is due to the limited availability of such products.
5.6 The Merchant reserves the right to inform the User in case of subsequent reasons that make the product unavailable or the possible (new) delivery time if there are reasons for delaying the delivery. In this case, if it is deemed that the delay makes the transaction unprofitable for the User, the User is entitled to unilaterally cancel the order by written declaration (by e-mail to thecartgr@gmail.com). If the order is cancelled and thus the sales contract is terminated, the Company must refund, without undue delay, all the money paid by the User.
5.7 The company, in good faith, is not liable and is not bound by electronic data entries made by mistake/overlap in common experience and is entitled to correct them whenever it becomes aware of their existence. The above warranties are subject to any technical or typographical errors which cannot be foreseen or have occurred unintentionally or due to interruptions in the operation of this website or even due to force majeure.
6. Confirmation/Execution of the order
6.1. This email on behalf of the company, is only a confirmation that the order has been received with the stated content and in no case constitutes an acceptance of the order or an agreement on the terms of sale. No modification of the order or new agreement on it shall be accepted.
6.2 If the company ascertains the availability of the items and the correctness of the order and the absence of any errors in the online store regarding the pricing of the items, their characteristics, etc., it confirms via a subsequent email the acceptance of the order, its content and the estimated time, in which case only then the sale is considered to be concluded and gives rise to claims on both sides.
7. Payment Methods
7.1.
Payment to the Courier upon delivery of the order, without credit card. The cost is 3€ for destinations within Greece. The company reserves the right not to proceed with cash on delivery to customers who in the past have not accepted orders that have arrived at the delivery address.
7.2. Using a Credit or Debit Card
Possibility to pay the amount of the order using a credit, debit or prepaid card through the secure environment of the National Bank of Greece, without any additional charge/cost of service. The Company accepts Visa, Visa Electron, Maestro and MasterCard cards. The Merchant has taken all necessary measures to ensure the security of your card transactions. The Business is not responsible in the event of an error in the recording of data by the client, as well as for the truth of the data reported. The customer is solely responsible. Also, the business is not responsible for any problems that may occur during the transaction. The processing of the User's card details is done solely for the completion of the transaction, i.e. the payment of the products purchased by the User from the site. The processing of personal data is governed by the Privacy Policy and the Cookies Policy of the Company.
7.3. Bank Deposit
Any order in which you select bank deposit as a payment method, is held pending until the deposit of the amount is completed, with a maximum of three (3) working days. Otherwise, the order will be cancelled without further notice. Any bank charges for the deposit shall be borne by the customer. The User must fill in his/her full name and order number in the reason for the deposit. The amount transferred should include shipping costs, if applicable. After the transfer-deposit of funds, the deposit should be notified to the company by sending an email to thecartgr@gmail.com, with the proof of deposit attached and indicating the order number and the full name of the User for immediate processing of the order.

7.4. IRIS Payment
The Merchant provides the possibility of payment through the IRIS service to the VAT number 149202607 or by scanning the QR code or to the mobile number 6985029777 with the order number and the User's full name. The amount transferred should include shipping costs, if applicable.
8. Shipping and Delivery of Products
8.1. Orders are sent by the courier company "ACS COURIER" or "ELTA COURIER" and the indicative delivery time is 1-3 days for Land Greece and 2-4 working days for Island Greece and inaccessible land destinations.
8.2 The Merchant is not responsible for any delays in delivery beyond the scheduled time. Requests for orders received on Saturday and Sunday are executed on Monday, while requests received on public holidays are executed on the next working day.
8.3 Shipping costs amount to 3€ and for purchases over 50€ shipping is completely free of charge. For sending any parcels beyond the usual size/weight, the shipment and the cost is made upon contact with the User, in accordance with the applicable charges and the tariff policy of the respective courier company.
After the order is completed, an e-mail is sent with detailed information and the shipping number. In case the delivery area is not covered by the company's distribution network, the customer is informed in advance of the delivery charge and assumes all relevant obligations towards the carrier. The undertaking is discharged on delivery of the goods to the carrier.
8.4. Shipping Orders to Cyprus
Orders are shipped by the courier company "ACS" and the indicative delivery time is 2- 4 days.
Shipping costs amount to 17€ and are valid for parcels weighing up to 2 kg. For orders over 2 kg there is an additional charge of 5€ per kg.
9. Pick up from the store.
9.1. In this case, after sending the Order Form via e-mail, it is possible to receive the order during the days and hours of operation of the store (Mon-Tu-Fri: 10:00-14:00 & 17:30-21:00 / Wed-Wed-Wed-Sat: 10:00-14:00).
10. Cancellation, Refunds & Changes Policy
10.1:
The product is in the same condition as it was at the time of delivery, i.e. not worn, not used, not washed, not showing any wear, defect or unwanted odours and is accompanied by its packaging, the label (tag) and the receipt or purchase invoice.
10.2 The return of the product is possible in the following cases:
α. When the product delivered to you is not what you ordered. In this case, the product must be returned within 14 days of delivery, otherwise the Merchant is not obliged to make a second delivery.
β. When the product has material defects, you may request a replacement, a reduction of the price or a full refund.
In these two cases (a and b), we bear the cost of return only if you send the products with the same courier company "ACS COURIER" or "ELTA COURIER" that you received.
In case you wish to use another courier company, you will bear these costs. The product must be carefully placed in its packaging to avoid possible damage during transport.
10.3. Change of product.
Within 14 days of delivery, you have the right to exchange the product you received with a product of the same price or higher, paying the difference. Exchanges can only be made by telephone at +(30) 2463400040 ( Mon-Sat: 10.00-14.00 ) or email thecartgr@gmail.com and only with the purchase receipt accompanying the goods. Otherwise you will be charged an additional 7€ in the exchange process. You will be responsible for the cost of any damage caused to the product upon return. If you do not wish to make your change immediately, you have the right to use the value to make purchases within 60 calendar days. Otherwise, the value of the amount will be lost. In the event that a product is returned to us which has suffered any damage, in relation to its original condition, the company reserves the right to exercise all its legal rights, reserving the right to claim any compensation of any kind. For reasons of hygiene changes to jewellery & accessories are not accepted.
10.4 In any case of return or exchange you must inform us of the tracking number of the shipment so that we can monitor the process.
11. Right of Withdrawal
In case you want to cancel your order from the site for any reason you have the right to cancel and return your order within 14 days, for any reason and without justification, if you fall under the concept of consumer according to Law 2251/1994 as in force. The exercise of the right of withdrawal is possible only within 14 days from the receipt of the product. If the 14-day period for exercising the right of withdrawal expires on a non-working day, the period shall be extended until the next working day. By exercising the right of withdrawal, you are obliged to return the product to us in its original perfect condition (as new) in which it was delivered to you. In any case, the products you wish to return must be accompanied by the necessary legal documents and receipts.
In case of exercising the right of withdrawal you must inform us at our contact details (by email at thecartgr@gmail.com, or by phone at ++(30 ) 2463400040 ) and then send back the product. You can also use the preprinted withdrawal form. The costs of returning the products are entirely at your expense. The products must be sent to us without undue delay and in any event within 14 days of our notification. In any case of exercising the right of withdrawal, you must inform us of the tracking number of the shipment so that we can monitor the process. The company will make a refund to the customer, using the same method of payment that you had chosen when you purchased the product. The refund will be made within 14 days from the day the business receives the product.
In case you have paid by payment card, we will proceed with the instruction to the card issuer when the product is returned to us and we are not responsible for any delays in crediting the price that are not due to us. In case the payment for the order was made by bank transfer or cash on delivery, the refund will be made to the bank account you have indicated in the return form. In any case, you will be sent an informative e-mail with proof of transfer to the e-mail address you provided when placing the order.
The consumer is liable for any reduction in the value of the goods only as a result of the handling of the goods other than that necessary to ascertain the nature, characteristics and functioning of the goods. We shall not be liable and shall not compensate a consumer or give effect to a withdrawal in the event that damage to the goods has been caused by the consumer's fault or in the event of use which exceeds that which is necessary to ascertain the nature, characteristics and function of the goods.
You are not entitled to withdraw in the cases of article 3b of Law 2251/94 and in any other case where this is provided for by law or herein in accordance with the law. Indicatively, you are not entitled to exercise withdrawal in products that are not suitable for return for health protection or hygiene reasons such as underwear, headphones.
12. Limitation of liability
Given the nature and volume of information on the Internet, under any circumstances, including in the case of negligence, the Company is not liable for any form of damage suffered by users of the pages, services, options and content of the site which they undertake on their own initiative.
In addition to what is expressly set forth herein, the Merchant shall not be liable in any civil, criminal, or any other way against you and/or any third party that derives rights from you, in the event that any of the above, while using the services and/or products of this site, suffers direct, indirect, consequential, incidental, consequential economic or other damage, lost profits, due to: (a) errors, omissions, technical stoppages, failures or malfunctions of the telecommunications networks, the Internet, the website, the Internet Service Providers; (b) permanent or temporary interruption of the website or certain services and/or interruption of the provision of certain products through the website, (c) events, circumstances, actions, deeds and/or omissions of the Site or third parties including other Users for which it does not provide guarantees and is not liable as set out herein; (d) information and other content that may be published and communicated by third parties.
13. Absence of guarantee
The Merchant provides the Website "as is" without any warranty. The Merchant does not provide any guarantee that the pages, services, functions, options and contents of the Site will be provided without interruption, without errors and that errors will be corrected. The Merchant does not warrant that any content or information obtained through the Site will be accurate. Although every effort is made, no guarantee is given that the Site is free of viruses or other harmful components.
14. External connections
The company does not control the availability, the content, the personal data protection policy, the quality and completeness of the services of other websites and pages to which it refers through hyperlinks or banners. Therefore, for any problem that may arise during their visit/use, users must contact directly the respective websites and pages, which are fully responsible for the provision of their services. Under no circumstances shall the Company be deemed to endorse or accept the content or services of these sites and pages to which it refers or to be associated with them in any other way.
The Merchant has no responsibility for the user's communication with the third party service providers advertised on www.thecart.gr for any commercial transaction that may arise from the relationship between them.
15. Other Terms
Users are responsible for accessing the services of the site and paying any fees to third parties (e.g. internet service providers, charging for time spent on the site). They are also solely responsible for equipping themselves with the necessary technological means to access its services.
The Users agree that to the extent permitted by applicable law, they will be liable to the Merchant for the compensation of any damage, including attorney's fees, caused by or related to their use of the Site or to the violation of these Terms.
The Merchant reserves the right to amend and update the content of these Terms either to comply with the law or due to changes in our business practices, needs, etc. For this reason, Users should visit this page frequently in order to be informed of any changes. Use of the Site at a subsequent time will also imply re-acceptance of the amended Terms.
No modification of these terms shall be considered and shall not form part of this Agreement unless it is in writing and incorporated herein.
Any provision of these Terms that becomes contrary to law shall automatically cease to have effect and shall be removed from these Terms without in any way affecting the validity of the remaining Terms.
The present constitutes the entire agreement between the Merchant and the visitors/users of its pages and services and shall not be binding only on them.
16. Code of Conduct

17. Alternative Dispute Resolution
The legislation provides for the possibility of electronic resolution of consumer disputes through the Alternative Dispute Resolution (ADR) procedure throughout the European Union. In case of problems in connection with a purchase made through our website, the possibility of electronic resolution through the ADR procedure is given through the platform for electronic dispute resolution (platform EDR).
18. Applicable Law
The above terms and conditions of use of the site, as well as any modification thereof, are governed and supplemented by Greek law, the law of the European Union and the relevant international treaties.
The competent courts for any dispute arising from the use of the Site are the courts of Thessaloniki.
